Tyson Coffee Shop Membership Terms of Service

Effective Date:  1 February 2025

These Terms of Service ("Agreement") govern the use of the membership program ("Membership") at Tyson Coffee Shop ("we," "us," or "our"). By purchasing or using a membership, you agree to be bound by the following terms and conditions. Please read this Agreement carefully before enrolling in the Membership.

1. Membership Enrolment

1.1 Eligibility: Membership is available to individuals who are 18 years or older and who agree to abide by these Terms of Service.
1.2 Sign-Up: To become a member, you must complete the sign-up process on the Tyson Coffee Shop website (tysoncoffeeshop.co.za) or in-store. You will be required to pay a fee of R100 for a 30-day membership.
1.3 Renewal: Your membership will automatically renew every 30 days unless canceled prior to the next billing cycle. Each renewal will be subject to the current membership fee.

2. Membership Benefits

2.1 Exclusive Access: Membership grants access to exclusive benefits, including, but not limited to:

  • Special discounts on products (coffee, cannabis products, and merchandise)
  • Members-only promotions and events
  • Priority access to new products and limited-edition items
  • Exclusive member-only content and updates
  • VIP experiences in-store (as available)

2.2 Limitations: Benefits are subject to change at Tyson Coffee Shop’s discretion, and not all products or services are eligible for discounts under the Membership.

3. Payment and Billing

3.1 Payment Method: Payment for the Membership fee of R100 is required upon sign-up. Accepted payment methods include credit card, debit card, and other approved payment methods.
3.2 Automatic Billing: By enrolling in the Membership program, you authorize us to charge the payment method on file for R100 every 30 days unless the Membership is canceled before the next billing cycle.
3.3 Payment Failure: If we are unable to process your payment, we may suspend or cancel your Membership until a valid payment method is provided.

4. Membership Term and Cancellation

4.1 Membership Duration: Membership is valid for 30 days from the date of enrolment, and will automatically renew unless canceled.
4.2 Cancellation by You: You may cancel your Membership at any time by logging into your account on our website or contacting our customer support team. Cancellations will take effect at the end of the current billing cycle, and no further charges will occur after the cancellation.
4.3 Refunds: Membership fees are non-refundable. Once the payment is processed, there are no refunds for partial months or unused benefits.
4.4 Termination by Us: We reserve the right to terminate or suspend your Membership at our discretion, including but not limited to violations of these Terms of Service or inappropriate behavior.

5. Member Conduct

5.1 Respectful Behavior: As a member, you agree to act respectfully towards our staff, other members, and the Tyson Coffee Shop community. We reserve the right to suspend or terminate your Membership if you engage in disruptive, inappropriate, or unlawful behavior.
5.2 Compliance with Laws: You agree to comply with all applicable laws and regulations in relation to the use of the Membership, particularly in the case of cannabis products. All cannabis products are intended for personal use only by individuals of legal age.

6. Privacy and Data Use

6.1 Personal Information: By signing up for Membership, you consent to the collection, use, and processing of your personal information in accordance with our Privacy Policy.
6.2 Marketing Communications: By joining the Membership, you may receive marketing emails and promotional offers from Tyson Coffee Shop. You can opt-out of these communications at any time through the provided link in the emails or by contacting customer support.

7. Limitation of Liability

7.1 No Liability for Damages: Tyson Coffee Shop shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Membership benefits.
7.2 Indemnification: You agree to indemnify and hold Tyson Coffee Shop harmless from any claims, losses, or damages arising out of your use of the Membership or any breach of these Terms of Service.

8. Changes to Terms

8.1 Modification of Terms: Tyson Coffee Shop reserves the right to modify or amend these Terms of Service at any time. Changes will be posted on our website, and you will be notified of any significant updates. Continued use of the Membership following any changes constitutes your acceptance of the revised terms.
8.2 Effective Date: The latest version of these Terms of Service is always available on our website and will take effect upon posting.

9. Governing Law

9.1 These Terms of Service shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
